Mayor Michael Bloomberg continued his media campaign for his failed big-soda ban with an appearance on the “Dr. Oz Show” Tuesday.

The mayor said the city needed to stop the sale of sugary drinks greater than 16 ounces from most locations because the obesity epidemic will kill millions.

Bloomberg disagreed when Oz played devil’s advocate and asked if the plan if OKd would make the city a nanny state.

“In the end, if expanding people’s lives isn’t the primary purpose of government then I don’t know what is,” he said.

On March 11, a New York Supreme Court judge invalidated the ban the day before it was set to be enacted.

In his ruling in a suit filed by soda companies and other groups against the city, the judge called the ban “arbitrary and capricious.”

The city’s Health Department will appeal the decision in June.
